Audigy Class Action Suit Settled

Creative Labs was sued in California over the misleading information that the Audigy 1/Extigy based soundcards supported 24bit/96000 sound processing. A settlement has been reached, and a 25 percent discount will be offered to anyone being able to prove that they are an owner of one of these soundcards. The only proof required to receive such a rebate is your soundcard's serial number.



In order to qualify for a certificate good for 25% off the sales price of any one Creative product, not to exceed sixty-two dollars and fifty cents ($62.50) off, you must provide the model and serial number of your Audigy ES, Audigy Platinum, Audigy Platinum eX, Audigy Gamer, Audigy MP3+, or Extigy model sound card ("Sound Card"), your address and the other information required by the form below. In order to make a claim, you must be dissatisfied with the audio processing capabilities of your Sound Card and you must release all claims against Creative, as set forth below. You may not submit more than one claim with respect to each Sound Card you purchased, and each claim must relate to a separate Sound Card. All claims are subject to verification and validation by Creative. Certificates received in this settlement may be redeemed only at Creative's online store at http://us.creative.com.

If you did not purchase a qualifying Sound Card at some time between March 28, 1999 and December 29, 2004, you are not eligible to make a claim and should not submit a Claim Form.

Please refer to the Class Notice and the Settlement Agreement posted at www.audiocardsettlement.com for additional information concerning eligibility, and processing of claims and time limtits on this claim process, the number of claims that can be submitted, procedures for disputed claims and other matters.

Your claim is subject to validation by Creative. Your claim will not be processed until after the Effective Date of the settlement which will not occur until July 24, 2005 at the earliest.

Nice settlement on Creative's part - they lose no "real" money this way & those who get the discounts will now need to spend more (probably) money to get to use the voucher. I guess this is 1 of the "win, win" situations on thir part.

yeah man its always like that...

For example if your pissed off with an airline company, and complain, they will give you some discounts off of future tickets..

Obviously you wont be buying any tickets in the future so they are useless, and even if you did they would end up making more money.

Done. Although it isn't going to do any good, at least I'll get a discount on a future puchase I'll never purchase.

If I didn't know better, I would swear this was a marketing strategy to get Audigy 1/Extigy owners to upgrade their sound cards. LOL
