Filesharing Safe? Not Anymore

Posted by: [PM] on: 02/07/2003 02:09 PM [ Print | 4 comment(s) ] · 1619 views

Last night a contributor of MSFN from Sweden sent a very interesting mail to the editors, containing a legal notice telling him that he has been monitored sharing copyright protected files over the sharing program 'Direct Connect'.

The letter has been composed by the Director of Enforcement from Mediaforce in New York. The Director of Enforcement wrote this letter on behalf of New Line Cinema Corporation, a division of AOL Time Warner ("New Line"). IP, downloading time and username were also included in the letter.

This is one of the first real evidences that big media companys like AOL Time Warner behalf divisions, which monitor the sharing networks for copyright violation.

It looks like a real letter, but for some reason I have a nagging feeling that tells me it's fake.

Why? There are several spelling mistakes in the letter, and if it was from some high and mighty official, they wouldn't mis-spell words like:

thet we have a good faith belief thet

and

Also , we hereby state , under penalty of perjury, under the laws of the State of California and under the laws of the United States, thet the information in this notification is accurate and thet we are authorized to act on behalf of the owner of the exclusive right being infringed as set forth in this notification.

And

We have recieived information that an individual has utilized the above-referenced IP address at the noted date and time to offer downloads of copyrighted motion picture(s) through a "peer-to-peer" service , including such titel(s) as:

--

Further reading of this letter, does raise some doubts about the authenticity of this document, and I believe someone got upset at being kicked out of a DC room and decided to enact some revenge by scaring the ISP in to killing that user's account!

The scanned picture of this paper was floting around in IRC yesterday and if I remeber right the spelling errors did not exist on the actual paper.
If it is real, it might still be just some angry user trying to mess with someone but even if it actually is New Line who sent it to the ISP fist then what kind of evidence is this?
A filename, filesize and IP??? Anyone can get that info! What does it really prove?
New Line is not the police and is therefore just as trustworthy(not) as anyone right?
